1. About Wavee
Wavee is an online marketplace operated by Vela Advisory (“we”, “us”, “the Platform”) that connects watersport providers with riders in the United Arab Emirates. Wavee facilitates bookings, payments, and communications but does not itself provide watersport services. All sessions are delivered by independent providers who are solely responsible for the quality, safety, and legality of their services.
2. Eligibility and Account Registration
You must be at least 18 years old to create an account. If you are booking on behalf of a minor, you accept full responsibility for their participation and must sign any required safety waivers. You agree to provide accurate, current, and complete information during registration and to keep your account details up to date. You are responsible for all activity under your account and for maintaining the confidentiality of your login credentials.
3. Bookings and Payments
All payments are processed securely through Stripe in AED (United Arab Emirates Dirham). Prices are set by providers and may vary by time, date, and season. Wavee charges a service commission on each booking, which is included in the displayed price. By completing a booking, you agree to the provider’s cancellation policy displayed on the listing page. A booking is confirmed only once payment is successfully processed.
Wavee is not responsible for payment processing failures caused by your bank, card issuer, or Stripe. If payment fails, the booking is not confirmed and no slot is held.
4. Cancellations and Refunds
Each boat listing has its own cancellation policy configured by the provider, defining refund percentages based on how far in advance you cancel. Provider-initiated cancellations always result in a 100% refund.
Weather cancellations receive a full refund when the provider cancels due to unsafe conditions (wind speed exceeding 25 km/h, thunderstorms, heavy rain, or maritime authority restrictions). Riders who cancel citing weather that does not meet these thresholds are subject to the standard cancellation policy.
Refunds are processed to your original payment method within 5–10 business days. Wavee does not control your bank’s processing time.
5. Assumption of Risk
Watersport activities involve inherent risks of injury, illness, or death. By booking a session through Wavee, you acknowledge these risks and agree that you participate voluntarily. Providers may require you to sign a safety waiver before your session. Failure to sign a required waiver may result in the provider refusing service without refund.
You confirm that you are physically fit to participate and that you do not have any medical condition that would be worsened by boat movement or watersport activity.
6. Provider Responsibilities
Providers are responsible for the accuracy of their listings, maintaining up-to-date availability and pricing, the condition and safety of their equipment, and compliance with all applicable UAE maritime regulations, Coast Guard requirements, and business licensing. Providers must hold adequate liability insurance covering their operations and passengers.
7. User Conduct
You agree not to: misuse the platform or interfere with its operation; submit false, misleading, or fraudulent information; harass, threaten, or discriminate against other users; circumvent the platform to avoid commission (e.g. arranging direct bookings with providers found through Wavee); use automated tools to scrape, copy, or extract data from the platform; or violate any applicable law or regulation.
Wavee may issue warnings, suspend, or permanently terminate accounts that violate these terms, at our sole discretion.
8. Marketing and Communications
By creating an account, you consent to receive transactional messages related to your bookings (booking confirmations, reminders, cancellations, payment receipts) via email and WhatsApp. These are essential to the service and cannot be opted out of while your account is active.
We may also send you promotional communications about new features, activities, offers, and platform updates via email and WhatsApp. You may opt out of promotional messages at any time by clicking the unsubscribe link in any marketing email, replying STOP to any promotional WhatsApp message, or adjusting your preferences in your account settings. Opting out of marketing does not affect transactional messages.
Wavee may use anonymised and aggregated booking data for marketing purposes, including testimonials, statistics, and case studies, without identifying individual users.
9. Reviews and User Content
Riders may leave reviews after completed sessions. Reviews must be honest, based on your genuine experience, and free from offensive language. Wavee reserves the right to remove reviews that are fraudulent, abusive, or violate these terms. Providers may not offer incentives in exchange for positive reviews or threaten riders to remove negative reviews.
10. Intellectual Property
The Wavee platform, including its design, software, logos, and content (excluding user-uploaded content), is the property of Vela Advisory and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the platform without our written consent.
Content uploaded by providers (photos, descriptions, logos) remains their property. By uploading content, providers grant Wavee a non-exclusive, worldwide, royalty-free licence to display, reproduce, and distribute this content on the platform and in marketing materials for the purpose of promoting their services and the platform.
11. Limitation of Liability
Wavee acts as an intermediary connecting riders with providers. To the maximum extent permitted by applicable law:
- Wavee is not liable for injuries, damages, losses, or death arising from watersport sessions, provider conduct, equipment condition, or weather conditions.
- Wavee’s total aggregate liability to you for any claims arising from or related to the platform shall not exceed the total fees you have paid to Wavee in the 12 months preceding the claim.
- This limitation does not apply to liability arising from our gross negligence, wilful misconduct, or fraud.
The platform is provided “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.
12. Indemnification
You agree to indemnify and hold harmless Wavee, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your violation of these terms, or your participation in watersport activities.
13. Dispute Resolution
If you have a dispute with a provider regarding a booking, we encourage you to first contact the provider directly. If the matter is not resolved, contact Wavee support at support@wavee-ai.com and we will make reasonable efforts to mediate. Wavee is not obligated to resolve disputes but may issue refunds or take other action at its discretion.
Disputes that cannot be resolved informally shall be referred to the courts of Dubai, United Arab Emirates.
14. Force Majeure
Wavee shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, war, civil unrest, or prolonged infrastructure failures.
15. Account Deletion
You may permanently delete your account at any time from your profile settings. Deletion removes your personal data from our systems in accordance with our Privacy Policy within 30 days. Anonymised booking records may be retained for legal, accounting, and fraud prevention purposes.
16. Changes to Terms
Wavee may update these terms from time to time. We will notify registered users of material changes via email at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the updated terms. If you do not agree with the changes, you may delete your account before the effective date.
17. General Provisions
Entire Agreement: These terms, together with the Privacy Policy and any applicable provider terms, constitute the entire agreement between you and Wavee regarding your use of the platform.
Severability: If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Waiver: Our failure to enforce any provision of these terms shall not constitute a waiver of that provision or our right to enforce it in the future.
Governing Law: These terms are governed by the laws of the United Arab Emirates. The courts of Dubai shall have exclusive jurisdiction over any disputes.
